Who is Thinaire?
Thinaire™ Transmedia Network, Inc. (“Thinaire”) provides a secure cloud-based platform which enables brands, marketers, retailers, and others (our “Clients”) to create and deliver unique mobile engagement experiences to their customers. These experiences allow consumers to interact with the brands, retailers and causes they care about simply by placing their mobile devices in proximity to advertising media and real-world objects that have been embedded with NFC tags or by interacting with advertisements using other engagement technologies such as QR codes, SMS text, or Bluetooth Low Energy.
Scope
This Thinaire privacy policy (the “Privacy Policy”) is intended to inform you of our policies and practices regarding the collection, use and disclosure of any information you submit to us through the Thinaire Transmedia Network and http://www.thinaire.net. This includes “Personal Information,” which is information about you that is personally identifiable such as your name, e-mail address, cellular telephone number and other non-public information that is associated with the foregoing, as well as “Anonymous Information,” which is information that is not associated with or linked to your Personal Information and does not permit the identification of individual persons.
Thinaire complies with the U.S.–E.U. Safe Harbor framework and the U.S.–Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. Thinaire has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. By accessing or otherwise using Thinaire, you agree to the terms and conditions of this Privacy Policy, which is incorporated into and forms a part of the Thinaire terms of service (“Terms”). You expressly consent to the processing of your Personal Information and Anonymous Information according to this Privacy Policy.
Information Collected Via Anonymous Connection
When you first use Thinaire from your mobile phone, you will be connected to the Thinaire web servers via web client. This web client will collect certain information, including IP address, phone manufacturer, mobile operating system, browser information and HTML5 geolocation if you choose to provide permission. You may opt-out of location based services at any time by editing the setting at the device level or by emailing us atuserhelp@thinaire.net. We use location based information for the purpose of reporting to our clients on marketing media performance and for market research; to improve the Thinaire level of service; and to be better able to deliver to you relevant information which enhances the quality and value of your mobile engagement experience. We will only share this information with our clients and their authorized agents and Thinaire partners and affiliates.
Personal Information That You Provide
In general, we collect Personal Information that you submit to us voluntarily through the Thinaire mobile engagement experiences. We also collect information that you submit in the process of creating or editing your account and user profile on Thinaire. For example, our registration and login process requires you to provide us with your name, valid email address and password of your choice. When you personalize your profile and use the features of Thinaire, we will collect any information you voluntarily provide, and we may also request optional information to support your use of Thinaire, such as your ethnicity, gender and other demographic information. We collect information in the form of the content that you engage with during your use of Thinaire, such as products you are interested in, product promotions, requests for coupons, social sharing of product information, promotions and coupon offers, ratings and other information you generate as you use and engage with products and brands on Thinaire. We may also collect information about you and your friends who use Thinaire, from any social network you may have connected from, in order to provide you with a more personalized experience. For instance, we may collect your user ID or profile information that you have permitted to be displayed through Thinaire in order to display you as a friend or in association with your profile and collections. Additionally, we collect any information that you voluntarily enter, including Personal Information, into any postings, comments, or forums within the Thinaire community.
Email And Email Addresses
If you send an email to us, or fill out our “Request for Info” form through Thinaire, we will collect your email address and the full content of your email and other information you provide. We may use and display your full name and email address when you send an email notification to a friend through Thinaire or the social network from which you have connected to Thinaire (such as in an invitation, or when sharing your content).
Content provided by or hosted by Third Party
The content we send to you may originate from other sites or online resources maintained or operated by third parties. We do not control such third parties and are not responsible for the privacy practices or the content of such sites or resources. We encourage you to read the privacy policies of any such sites or resources as their privacy policies and practices may differ from our policies and practices.
Use and Disclosure of Information
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent, or otherwise share for marketing purposes the Personal Information that we collect with third parties, unless you ask or authorize us to do so. In general, Personal Information you submit to us is used by us to provide you access to Thinaire, to improve Thinaire, to better tailor the features, performance, and support of Thinaire and to offer you additional information, opportunities, promotions and functionality from us, at your request. We may provide your Personal Information to companies that provide services to help us with our business activities. These companies are authorized to use your Personal Information only as necessary to provide these services to us. Additionally, we do share your content preferences and other information with the social network with which you have connected to Thinaire, along with those companies and persons you have asked us to share your information with. If you do not want us to use or disclose Personal Information collected about you in the manner identified in this Privacy Policy, you may not use Thinaire. Additionally, we may create Anonymous Information records from Personal Information by excluding information (such as your name) that would otherwise make the Anonymous Information personally identifiable to you. Generally, we aggregate this information and use it in statistical analysis to help us analyze patterns in the use of Thinaire. This Privacy Policy does not limit our use or disclosure of any Anonymous Information in any way, and we reserve the right to use and disclose Anonymous Information to our partners, advertisers and other third parties at our discretion. We may share some or all of your Personal Information with Thinaire affiliated and group companies that are under a common control, so that they may send daily deal emails to you, in which case we will require them to honor this Privacy Policy. Some of those companies may be located in countries that do not require an equivalent or greater level of protection of Personal Information. In the event we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of ours or that acquirer’s assets may continue to process your Personal Information as set forth in this Privacy Policy. Tracking Technologies
We never associate your name or likeness with the information we collect without your permission. We use a non-personally identifiable means (“cookies”) to collect and store your Anonymous Information. Cookies are small text files that contain a string of characters that uniquely identify your device without your personal info. We use both session ID cookies and persistent cookies. We use session ID cookies to make it easier for you to navigate the mobile experience. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. We set a persistent cookie to store your passwords, so you don’t have to enter them more than once. The Ability Of Others To View Your Information
Helping you to protect your information is a vital part of our mission. It is up to you to make sure you are comfortable with the information you choose to provide us and the information you choose to publish. You understand that when you use Thinaire, certain information you post or provide through Thinaire, such as your name, profile, comments, collections and likes, may be shared with other users and posted on publicly available portions of Thinaire, including without limitation, social media applications and other public for a in which you choose to participate. Please keep in mind that if you choose to disclose Personal Information when posting comments or other information or content through Thinaire, this information may become publicly available and may be collected and used by others, including people outside the Thinaire community. We will not have any obligations with respect to any information that you post to parts of Thinaire available to others, and recommend that you use caution when giving out Personal Information to others through social media networks or otherwise.
Social Media Features and Widgets
Thinaire Transmedia Network services and website include social media features, such as the Facebook Like button and widgets. These features may collect your IP address, which mobile experience you are viewing or page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our platform. Your interactions with these features are governed by the Privacy Policy of the company providing it.
Links to Other Web Sites
The mobile experiences delivered by Thinaire and our website may include links to Client or other web sites whose privacy practices may differ from those of Thinaire. If you submit Personal Information to any of these other sites, your information is governed by their privacy policy. We encourage you to carefully read the privacy policy of any web site, including mobile websites, you visit.
Your Choices Regarding Your Personal Information
We offer you choices regarding the collection, use, and sharing of your Personal Information. You have a right at any time to stop us from contacting you for marketing purposes. If you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the promotional email you receive or by contacting us directly atuserhelp@thinaire.net. Despite your indicated email marketing preferences, we may send you administrative emails regarding Thinaire, including, for example, administrative and transaction confirmations, and notices of updates to our Privacy Policy if we choose to provide such notices to you in this manner. You have the right to request a copy of the Personal Information that we hold about you. We want to make sure that your information is accurate and up-to-date. You may ask us to correct or remove information which you think is inaccurate. We will retain your personal and location based information for as long as your account is active or as needed to provide your services. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Feedback
If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information.
